General terms and conditions
Background
Easyserv's service (the "Service") covers the monitoring and control of heat pumps at a specified address. The purpose of the Service is to ensure, as far as possible, that the customer's heat pump works optimally and delivers satisfactory energy savings according to the manufacturer's performance. It also aims to detect faults and damage at an early stage, thus allowing problems to be addressed in good time before they become acute.
Scope and purpose of the agreement
These terms and conditions govern the use of the service provided by Easyserv Sweden AB, 556948-4628
(hereinafter referred to as "Easyserv").
Hardware and service can also be sold and / or included in other agreements / services provided by Partners / Resellers
(hereinafter referred to as ÅF).
The buyer of the Service (hereinafter referred to as "Customer") can give service technicians or other agents (hereinafter referred to as "Agents") access to operating data / monitoring service.
By registering an account on any of Easyserv's web services, the customer approves and accepts these terms.
If the Customer does not accept the terms and conditions, he shall not register an account.
Guarantees
The Consumer Services Act applies between the parties for this type of service.
Customer's responsibility
The customer is responsible for ensuring that monitoring equipment has access to 230V and a functioning internet connection (if mobile data is used, this is included in the service at an additional cost).
Additional work related to the above, Easyserv or ÅF can charge if service visits are required to restore internet connection or power supply, this is agreed in that case before the visit.
Protected content
All material on the website is the property of Easyserv, its subcontractors and licensors. All material on the website is protected by copyright law and other protective legislation. It is not permitted to copy, modify, distribute or publish content from Easyserv without written permission from Easyserv. However, the customer has the right to use the material contained on the website for his own, non-commercial use.
Limited liability
Easyserv monitors and analyzes technical equipment in properties of various types, however, this does not mean that Easyserv takes responsibility for the function of connected equipment. We also do not take responsibility for any downtime / deviations being detected within a specific time frame, but the service should be used for long-term optimization of the performance and service life of the connected equipment and to capture abnormal operating conditions.
Any action taken by the Customer as a result of information provided on the website is entirely at the Customer's own risk.
Easyserv is not responsible for any damage or loss due to the Customer's or Agent's dealings with any third party, whether or not that party is recommended by Easyserv.
Easyserv is also not responsible for damage caused by the Customer or Agent using information contained in the Service or by information not being available.
In cases where Easyserv refers to a website belonging to a third party, such reference is intended solely as a service to the Customer and Easyserv disclaims all responsibility for the content of such website.
Easyserv is not responsible for damage caused by power failure, network failure or communication failure, malfunction / breakdown in the heating system, non-transmitted or communicated alarms / messages from the heating system, force majeure (lightning, war, sabotage, strike, extreme weather conditions, conflicts, fire or other unforeseen events beyond our control).
The management of personal data
Easyserv complies with the rules that, according to the General Data Protection Regulation (GDPR), aim to protect the user's privacy.
The personal data that the Customer provides to Easyserv - such as name, social security number, e-mail address, address and facility information - may be processed both manually and mechanically. The personal data is processed primarily to communicate with the customer / user, know where connected equipment is located and for the development of the Service. Easyserv may disclose the customer's personal data to subcontractors in order to fulfill the user's request for action / advice on connected equipment.
Easyserv is responsible for the processing of personal data and, according to the GDPR, the customer has the right to know what data is registered about him and for what purposes this data is processed. Customers can also request correction of incorrect data. Customers requesting information or correction must do so in writing to Easyserv by letter or

Operation of the Service and Customer Service
The Service is normally in operation around the clock. However, Easyserv reserves the right to take measures that affect the availability of the Service if Easyserv finds it necessary for technical, maintenance, operational or security reasons and the Customer understands that all or part of the Service may be shut down with immediate effect in the event that Easyserv deems it necessary for, for example, security reasons. Easyserv also reserves the right to change, add or remove functions in the Service at any time and to restrict the operation of the Service to, for example, implement updates and upgrades. Easyserv is not responsible in any way for interruptions or errors in the Service caused by or otherwise attributable to third parties. The customer is not entitled to compensation if the Service cannot be used as described above.

Cookies are used
In accordance with the Electronic Communications Act, the Customer is informed if the website uses cookies. Cookies are used in a number of functions aimed at making it easier for the Customer to use the service. Cookies cannot identify the customer personally, but only the browser installed on the computer used during the visit. If the Customer does not accept the use of cookies, he/she can configure his/her browser not to accept this or choose not to use the Service.
Changed conditions
Easyserv reserves the right to change the Terms of Use at any time by updating this page.
Right of withdrawal
This Agreement is subject to the Distance and Doorstep Selling Act (2005:59). If the total payment for the Service exceeds SEK 400 (or such lower amount as stipulated in the Distance and Home Sales Act), the Customer has the right to withdraw from the agreement within 14 days from the date the agreement was entered into. Customers who regret their decision must notify Easyserv if they wish to exercise their right of withdrawal.
Term and termination
This agreement enters into force on the date of the Customer's subscription to the Service by registering an account with Easyserv, either on its own or by this being arranged by Easyserv or ÅF. The agreement is valid until further notice and can be terminated by the Customer at any time by contacting Customer Service. Prepaid monthly fees paid are not refundable. In the case of various campaigns, the contract period may be bound for a certain time linked to a special offer.
Easyserv has the right to terminate the agreement with immediate effect if the Customer violates this agreement or Easyserv's instructions or if Easyserv otherwise deems that the Customer risks seriously disrupting the use of Easyserv's system or obviously misusing the Service.
Easyserv shall have the right to terminate the agreement by e-mail to the e-mail address provided by the Customer when registering for the Service.
In case of change of ownership
This agreement applies to the signed customer. In the event of a change of ownership of a property, the Customer may transfer the remaining contract period to the new owner. However, this must be reported to Easyserv no later than the date of access, otherwise the validity of the agreement will expire at the next contract period. Registration of change of ownership may be charged according to the price list.
Payment terms, pricing
Debiting and invoicing are primarily carried out against the means of payment that the Customer has connected to the Service.

If the Customer registers a credit or debit card, purchases are automatically debited from the specified card. By registering a credit or debit card, the Customer consents to the processing of the registered card details by Easyserv [and any third parties for the administration of the payment].
It is the Customer's own responsibility to always have a valid card connected to the Service and that funds are available for debiting in accordance with the Agreement.
When the Customer closes the user account, any card details are also deleted.
Easyserv / ÅF has the right to annually adjust the contract price according to TPI (service price index). Price adjustment may take place no earlier than 12 months from the start of the agreement. The customer is aware that credit checks can be made without separate approval. VAT is included in all prices.
